Redundancy

At some point business owners may find themselves facing a downturn or a need to streamline operations to remain competitive and profitable. This will invariably entail making staff redundant. Following a correct process is crucial, not least because you need to retain the best workers but also because an unfair redundancy selection will invariably lead you to the tribunal door.

We have tried and tested selection criteria, warning, consultation and dismissal letters and can guide you through the process from start to end, ensuring that you act in such a way that if a redundancy is challenged you will be able to demonstrate you acted fairly and reasonably in coming to your decision.

Tribunal Claims

We live in a society where no win – no fee solicitors are only too happy to take on unfair dismissal, discrimination, whistleblowing and non-payment of wages cases to name but a few. Getting it right reduces the chances of litigation, but getting it wrong can leave you exposed to a costly tribunal claim. TCS have been representing clients in the Employment Tribunal and Employment Appeal Tribunal for over 20 years and have a wealth of experience in tribunal process and advocacy.

Business Transfers

One of the most challenging aspects of purchasing or selling a business is the status of the workers in the business. Who transfers is often a moot point which can influence a decision as to whether the purchase or sale is cost effective. Buyers and sellers also need to follow a statutory process and inform those who may be affected by the transfer and that does not mean just those that are transferring.

Employee investigations

From time to time TCS are called upon to investigate employee misconduct or capability. We can assess employees from an external perspective with an impartial approach which may not always be possible within a small organisation.
